1. Agreement to Terms
By accessing and using RecruitBase — a Candidate Evaluation Intelligence platform — you accept and agree to be bound by the terms of this agreement. If you do not agree to abide by these terms, please do not use this service.
2. License Grant
RecruitBase grants you a limited, non-exclusive, revocable license to use the platform — including its structured scoring engine, culture alignment tools, persona forms, fit scoring, candidate projection, and evaluation audit trail — in accordance with these terms. You may not reproduce, distribute, transmit, or adapt any part of our platform without written permission.
3. User Responsibilities
You agree to:
- Provide accurate and complete information when creating and managing your account
- Maintain the confidentiality of your account credentials
- Comply with all applicable laws and regulations in your jurisdiction
- Not engage in unauthorized access, data scraping, or fraudulent use
- Not upload malicious code, harmful content, or false candidate data
- Respect candidate data privacy, dignity, and legal rights at all times
- Use evaluation outputs — including fit scores, projections, and persona form results — responsibly and not as the sole basis for hiring decisions
4. Candidate Data and Evaluation Records
RecruitBase is used in connection with employment evaluation decisions. You acknowledge and agree that:
- You are responsible for obtaining necessary consents from candidates before processing their data on the platform, including for persona forms and AI-generated assessments
- Evaluation Audit Trail records and PDF exports must be stored and used in accordance with your organization's data retention policies and applicable employment law
- Candidate Fit Scores and performance projections are AI-assisted decision-support tools — they do not constitute employment assessments under FCRA, EEOC, or similar regulatory frameworks unless you are specifically using the platform for such purposes
- You are responsible for compliance with applicable employment laws, including the Fair Credit Reporting Act (FCRA), Equal Employment Opportunity (EEO) regulations, GDPR, and any relevant regional data protection laws
5. AI-Generated Content
RecruitBase uses AI language models (including DeepSeek) to generate certain content within the platform, including:
- Persona Form questions tailored to specific roles
- Candidate Performance Projections (3-phase ramp narratives)
- Risk flags and suggested interventions within projections
You acknowledge that AI-generated content is inherently probabilistic and may contain inaccuracies. RecruitBase does not warrant the accuracy, completeness, or fitness for purpose of any AI-generated output. You are solely responsible for how you use, share, or act upon AI-generated content.
6. Immutable Audit Trail
The Evaluation Audit Trail is designed to be immutable — events recorded within the trail cannot be edited or deleted by users. This is by design and is central to the platform's compliance and accountability guarantees. You agree not to attempt to circumvent, falsify, or manipulate audit trail records. Exported PDF audit reports are point-in-time snapshots and are not retroactively updated.
7. Intellectual Property
All content, features, and functionality of RecruitBase — including the scoring engine architecture, culture alignment model, persona form generation system, fit score algorithm, and projection methodology — are owned by RecruitBase, its licensors, or other providers of such material and are protected by international copyright, trademark, and other intellectual property laws. Candidate data, evaluation records, and audit exports generated through your use of the platform remain your property, subject to your compliance with these terms.
8. Limitation of Liability
To the fullest extent permitted by law, RecruitBase shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service, including any reliance on fit scores, candidate projections, or AI-generated persona assessments in hiring decisions.
9. Indemnification
You agree to indemnify and hold harmless RecruitBase from any claims, damages, losses, or expenses arising from your use of the platform, your violation of these terms, your hiring decisions made using platform outputs, or any breach of applicable employment or data protection law caused by your use of RecruitBase.
10. Service Availability
RecruitBase is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted service and are not liable for service interruptions, data loss, or other disruptions. AI-generated features (projections, persona questions) are dependent on third-party model availability and may be temporarily unavailable.
11. Termination
RecruitBase may terminate or suspend your account at any time for violation of these terms or for any other reason, with or without notice. Upon termination, your access to evaluation records, audit trails, and exported data will be subject to our data retention policy outlined in our Privacy Policy.
